This privacy statement relates to services provided by Open Dutch Fiber B.V. ("ODF", "we" or "us"), located at Kosterijland 50 (3981 AJ) in Bunnik, registered in the Dutch Chamber of Commerce under number 81920717.
We process personal data because you use our services. website to construct, maintain, and manage fiber optic networks and connections in the Netherlands, or about the services on the fiber optic network or other activities, such as for business operations, job applications, and events. 1. PERSONAL DATA AND PURPOSES
A personal data is any information that can identify a natural person (directly or indirectly). We process the following personal data because you use our website and/or because you provide it to us yourself. Of course, we will not retain the data longer than necessary for the purpose for which it was collected.
1.1 Contact in the context of our services
Through the website, you can contact us regarding our services: the realization, maintenance, and management of the fiber optic network and your fiber optic connection.
In order to roll out the fiber optic network in your area, we use address data from the Basic Registration of Addresses and Buildings (BAG) via the Cadastre and enter into discussions with your municipality. We inform residents about the work to be carried out, and if you wish to have a fiber optic connection, we will record the agreement along with your name, address, email address, and IP address. We may also be in contact with your housing corporation or association of owners (VvE) and inform you through that channel or directly. You can use a postcode checker to verify if we provide a fiber optic connection in the area where you live and provide your address and contact information to connect you to our network.
The fiber optic network and the services on the fiber optic network are separate. If you want to use services over our fiber optic network such as internet, television, and/or telephone, then as a resident or business customer, you need to take out a separate subscription with a fiber optic provider. You can see which providers are available via our website. Fiber optic providers provide services and can help you put together the package.
We do not store your data longer than necessary. However, we have a legitimate interest within the meaning of Article 6(1)(f) of the GDPR to process your personal data, as this data is necessary to assess whether we can connect you to our fiber optic network. If you have a connection, we will use your data to carry out this connection.
1.2 News updates and relevant information
You can sign up to receive newsletters and updates (for example, via the website) from us. We use the information you provide, such as name, address, and email address, as well as the topics for which you wish to receive updates and information. We process this personal data based on your consent as laid down in Article 6(1)(a) of the GDPR. You may always withdraw your consent. This can be done via the link in the email we send to you or by contacting us using the contact information below. We will keep your data for this purpose until the subject for which you wish to receive updates is no longer current or if you unsubscribe.
1.3 Analytical purposes
The data we receive about you through the website, such as your place of residence and postal code, can be used in anonymized or pseudonymized form for analytical and statistical purposes. Based on this information, we can optimize our services. We have set up Google Analytics in a privacy-friendly manner. We have shielded the last two digits of your IP address to protect your privacy as much as possible. We also anonymize your data after conducting the analysis. However, we have a legitimate interest within the meaning of Article 6(1)(f) of the GDPR to process your personal data, as this data is necessary to optimize our business operations. 1.4 Cookies, or similar technologies, that we use
A cookie is a small text file that is stored in the browser of your computer, tablet, or smartphone when you first visit this website. We use functional, analytical, and tracking cookies and similar cookie technologies that store information on or read information from your peripheral equipment.
We use cookies with purely technical functionality (functional cookies). These ensure that the website works properly and that, for example, your preferences are remembered. For data processing that is not carried out by ODF itself but by another party, such as Meta (the parent company of Instagram and Facebook), that other party must have a legal basis, such as consent or legitimate interest. The terms, privacy policy, and cookie statement of the respective social media platform apply to the use of social media. The privacy policy of ODF does not apply to the use of such social media.
1.5 Location-based tools
We collect and use the geographic location of your computer, tablet, or smartphone. This way, we can better inform you about construction work and services that we believe may be of interest to you based on your geographic location, and to improve the services there.
1.6 Processing of inquiries, complaints, and damages
You can contact us to ask questions, file a complaint, report damage, or for any other reason. We record incoming messages in our customer service database or other department that handles your request. The mentioned processes are necessary for the performance of tasks such as your home connection, or to the extent that they do not arise from the execution of a contract, they are necessary to safeguard legitimate interests.
1.7 Customer Satisfaction Survey
We conduct customer satisfaction surveys to gain insight into the experience and satisfaction regarding the installation and connections of your fiber optic network, maintenance and management, and the services on the fiber optic network. Based on this, we can improve your experiences and services. Customer research is an integral part of our business processes. We may contact you by phone, send a questionnaire, or conduct a personal interview. We use your NTE data and the answers you provide for this purpose. We anonymize the results of the survey after conducting the analysis and will not contact you for marketing purposes. We have a legitimate interest within the meaning of Article 6(1)(f) GDPR to process your personal data because this data is necessary to optimize our business operations.
2. WHO DO WE SHARE PERSONAL DATA WITH?
We do not disclose your personal data to third parties in principle, and only do so if necessary for the provision of our services to you or to comply with a legal obligation. Think of performing administration for tax purposes, preparing and maintaining our activities, and providing information to a government or enforcement agency.We provide personal data to contractors if necessary to realize the connection to our fiber optic network. Additionally, with your permission, we may share personal data with fiber optic providers for the provision of services or for marketing purposes. We may also engage third parties in the context of service delivery, for the execution of the agreement, or IT services for maintenance or management of our systems and storage of your data. These third parties are processors on our behalf and process the data solely for our benefit and for no other purpose. In case of a claim, we may share information with our insurer or other relevant parties to comply with your request. When we transfer personal data, we make agreements to ensure that an appropriate level of protection is guaranteed. We do not pass on your personal data to (legal) persons outside the European Economic Area.
3. SECURITY OF PERSONAL DATA
ODF takes the protection of your personal data very seriously and implements appropriate technical and organizational measures to secure your personal data against misuse, loss, unauthorized access, unauthorized alteration, or any other form of unlawful processing. ODF is audited and certified for information security measures ISO 27001. Third parties that require access to your data are obligated to implement appropriate technical and organizational measures and to bind their employees to confidentiality.
4. CHANGES TO OUR PRIVACY POLICY
We may change our privacy statement from time to time by publishing the amended version on this page. When we change this statement, we will update the date at the top under 'last updated'. If the change is a fundamental change in the relationship we have with you, you will be informed about this change in advance via the usual communication channel.

You have the right to request us to:
